Terms and Conditions of Chalet Rental

1.Agreement
1.1 These terms and conditions form the basis of the agreement between the Chalet Owner (the owner) and the undersigned (hereafter referred to as “you”) for the holiday rental of an Alpine Comfort Property. Alpine Comfort Sàrl – 4 Valleys Chalet Rental (Agent) acts only as the rental agent on behalf of the owner.

1.2 By signing the Reservation Contract which will be attached to these T&C after a reservation is confirmed, you agree that you are over 18 years of age and that you accept full responsibility for all payments due and for the consequences of any actions of all persons who will use the property during your holiday. You also confirm that you have an adequate liability insurance that covers any damages to the property structure and/or its interior including furnishings caused either by you or any members of your party.

2.Booking
2.1 The agent will confirm the booking on receipt of the Reservations Contract and the required non refundable deposit of the property rental fee.

2.2 Once the agent has received the deposit and confirmed your reservation then an agreement exists between the parties on these terms and conditions (you & the chalet owner).

2.3 The agent will accept a provisional booking and reserve the property for your holiday provided that the deposit is paid within 7 working days.

2.4 If the holiday is due to start within 56 days of the date of booking the total of the holiday rental fee is payable at the time of booking.

2.5 No subsequent changes may be made to any part of the booking without the express written approval from the agent.

3.Payment
3.1 Payment can be made either by bank transfer net of charges, or by credit card. All credit card payments incur a 3% surcharge.

3.2 Final Payment
The balance of the property rental fee less any deposit will become due 56 days before the start of the holiday. If the balance is not received on time the agent reserves the right to cancel your booking and retain the deposit.

4.Breakage Deposit
4.1 A returnable breakage deposit is required which will be refunded 7 days following the period of occupation subject to satisfactory inspection of the property. A deduction will be made for any damage caused by occupants of the property and it’s contents. The amount of the required breakage deposit is depending on the property but will start at a minimum of Chf 1000.-

5.Cancellation
5.1 Cancellation by you
Any cancellation will come into effect the day written notice is received by the agent and will be refunded as shown in the table below excluding your non refundable deposit. Recorded delivery is strongly recommended.

The agent will seek to re-let the property for all or part of the booking period and, if successful, will refund the money paid by you less an administrative charge of Chf 250.-

5.2 Cancellation by the owner or the agent
5.2.1 In all cases, the agent or owner reserves the right to cancel your holiday for the dates you have reserved. This is extremely unlikely, but should this event occur you will be fully refunded.

5.2.2 If you fail to pay the balance of the booking price or other costs before the due dates, the agent reserves the right to cancel your reservation with no refund to you.

5.3 It is a condition that by signing the booking form you are in possession of a holiday insurance which covers you for any cancellations or breakages/damage to the property.

6. Amendments
6. 1 Amendments by you

6.1.1 Amendments must be confirmed in writing, signed by you or any authorized member of your group. They will come into effect on the day they are received by us. You agree to indemnify the agent for any reasonable expenses incurred in making an amendment whether or not the agent succeeds in confirming your request.

6.1.2 Subject to availability, any change of dates within the same season more than 56 days prior to departure will be accepted by the agent without charge. There might be a change of the rental price, as the properties have different seasonal prices.  A change of dates to a future season or within 56 days of departure will be deemed a full cancellation.

6.2 Amendments by the owner or the agent

6.2.1 The agent reserves the right to advise you of a change to your holiday both before and after you make a reservation. An amendment made prior to departure which is deemed to be significant by the agent (for example a change of dates or a change in accommodation standards) gives you the right to cancel the holiday if you choose. Should you cancel in such circumstances you will receive a full refund.

6.2.2 Once your holiday has started, the agent will pay you a pro-rata refund for any part of your holiday which, due to an amendment made by the agent, cannot be taken.

6.2.3 Please note that the agent cannot pay expenses, costs or losses incurred by you as a result of any change or cancellation and shall not be liable for any refund should the agent be forced to cancel or change your holiday due to circumstances amounting to Force Majeure. Such circumstances shall include, but are not limited to, war or threat of war, riot, civil strife, terrorism, industrial disruption, natural disasters, fire, technical problems, adverse weather, governmental action and similar events beyond our control.

7. Occupation of the property
7.1 You must not use the property for any purpose other than that of a holiday.

7.2 The number of people staying in the property must not exceed the maximum number stated and the use of tents or sleeping in motor vehicles adjacent to the property is not permitted.

7.3 You must not use the property for any activity or in such a way as to cause nuisance or annoyance to its visitors or its neighbours.

7.4 You and your guests must comply with any reasonable regulations relating to the property, or the site within which the property is situated, which will be communicated to you on your arrival at the property.

7.5 The owner nor Alpine Comfort Sàrl accepts any responsibility nor can be held responsible for any accidents, injuries and or sicknesses during your stay at the chalet. All the chalet facilities are used at your own risk.

8. Your Obligations
8.1 You agree to keep the property and its contents in the same condition and repair as on your arrival at the property and to pay to us upon written demand any costs incurred in making good any loss or damage to the property or its contents caused by your action or omission or that of any guest accompanying you.

8.2 No pet is permitted at a property

8.3 Smoking is NOT permitted in the property under any circumstances and ALL guests must agree to this. Any damage caused by smoking in the property will result in loss of breakage deposit.

8.4 You must allow us to enter the property during the holiday. We will endeavour to give you reasonable notice of such a visit except in an emergency when immediate access must be allowed.

8.5 You must ensure that the property is left in a clean and tidy condition on your departure at the end of your holiday. We may make a charge for any additional cleaning if this is considered necessary. Should there be rubbish bags and empty bottles at the chalet after your departure Alpine Comfort Sarl, will gladly do the recycling/disposal for you but will deduct the fee for the necessary work from your deposit.

9. Our Right to Refuse/Terminate
9.1 The agent reserves the right to refuse any booking.

9.2 The agent reserves the right to terminate this agreement and ask you and your guests to leave immediately if this is deemed necessary by the agent as a result of your behaviour or that of your guests or any other material breach by you of the terms of this agreement.

10. Arrival and Departure
10.1 The holiday rental period begins at 4.30pm on the first day of the booking period and ends at 10.00am on the day of the departure. If your stay extends beyond this period you may be subject to a charge for the additional time/days.

11. Description and facilities
11.1 The agent will endeavour to inform you at the time of booking of any changes to the brochure or web site description of the property or of any events which may be taking place at its site near the property during your holiday. The agent nor the owners do not accept any liability for any works or activity of any sort occurring on the premises adjoining or neighbouring the property.

12. Tenancy
12.1 This agreement is for the purposes of a holiday rental only and does not create the relationship of Landlord and Tenant between you and the owner or the agent. You will not be entitled to a tenancy or to any other form of statutory security of tenure as a result of this agreement.

13. Complaint
13.1 If you have any cause for complaint during your holiday at the property please notify the agent and they will make all reasonable efforts to assist and resolve the issue. The agent will not normally make any refund or recompense in respect of a complaint made after departure if the complaint was not made known to the agent during the holiday rental period.

14. Lost Property
14.1 The agent nor the owners shall not be responsible for loss or damage to any of your belongings or for any injuries sustained by you or any of your guests unless caused by the negligence or default of the agent or the owners.

15. Penalties
15.1 If either of the following occurs without approval, the penalties listed below will be charged immediately.
15.2 The stated occupancy of the chalet is exceeded, Chf 1000.- per extra person.
15.3 Pets are brought to the chalet Chf 1000.- per pet.
15.4 Smoking within the chalet Chf 10,000.-

16. Data Protection
16.1 All personal data provided to the agent will be held and processed in accordance with the requirements of the Data Protection Act. The agent will keep your personal data safe and secure.

The agent will not share it with other organisations without your knowledge and consent, unless required by law to do so.

17. General
17.1 Headings within these booking conditions are for reference purposes only and all images are intended to give a general impression only.
17.2 These booking conditions and any matters arising from them are subject to and governed by Swiss law.
17.3 The agent reserves the right to amend any of the booking conditions at any time. Any changes made will come in to force immediately and apply to all bookings regardless of whether they were made prior to the amendment. You will be informed of any changes and you have the right to act accordingly
17.4 The agent, Alpine Comfort Sàrl, CH-626.4.012.269-9 is registered in Switzerland.
